Abstract
ABSTRACT
Humans in the process of their development to continue their kind need a life partner who can give offspring according to what they want. Marriage is a way to create a happy and eternal family or household based on the One Godhead. This means that the marriage should last a lifetime and should not just end. Marriage is generally carried out by adults regardless of profession, religion, ethnicity, poor or rich, living in the village or in the city. The age of marriage that is too young has resulted in an increase in divorce cases due to a lack of awareness to be responsible for married life for husband and wife. This study aimed to reveal what factors encouraged young marriage and how judges considered in granting early marriage dispensation. The type of research used was qualitative research in the type of field research. This study used primary and secondary data. Data collection techniques used were observation, interviews and documentation. Data processing techniques used were edit, classification, analysis and conclusion. The results of this study iindicatd that: First, the factors driving the occurrence of early marriage are economic, parents, education, self and local customs factors. Second, the judge in granting the marriage dispensation prefers the rule: “Rejecting damage must take precedence over attracting benefit”.
